In the absence of stipulations to the contrary, the present General and Special Conditions of Sale apply to all contracts concluded between:
– Tity Voyages, hereinafter referred to as the “Agency”.
– On the other hand, any individual or legal entity using the services of the Agency, hereinafter referred to as the “Customer(s)”.
The “Participant” is any natural person taking part in the trip organized by the Customer.
The Agency offers the Customer(s) the possibility of either:
– A trip based on a prepared package (cruises, tours, seaside stays or day excursions) in one of the active destinations (Egypt, Jordan, Dubai… etc.).
Or,
– A trip to a country of Customer(s) choice by requesting a personalized program and quote with itineraries, excursions, activities, and accommodations.
Tity Voyages is a travel consulting agency. It works with carefully selected local service providers.
Any registration for a trip to any destination will be effective for the Agency upon receiving of a deposit, the amount of which is stipulated on the reservation page of the Tity Voyages website (Tityvoyages.com).
In the case of tailor-made trips, the Agency will send a personalized program and quote to the Customer(s). If the Customer(s) agrees, they will have to pay the personalized study package, to receive from the Agency all information required to book their personalized trip.
A reservation is only definitive after confirmation by the Agency of the availability of the stay.
The balance of the price of the services must be paid in, on site, by credit card or cash.
Upon confirmation of the booking, the Customer(s) will also be asked to provide as soon as possible information concerning all Participants in the trip (surnames, first names, e-mail address, WhatsApp telephone number), to guarantee reservations.
Special Sales Conditions may apply in the event of travel:
– in very high tourist season.
– or in certain regions.
– These conditions will be mentioned in the quotation sent to the Customer(s) and will prevail over the General Sales Conditions.
3.1- BEFORE THE TRIP:
All cancellations must be made by e-mail to the Agency.
Any deposit or package for personalized study paid is non-refundable.
Air tickets are non-refundable once the Agency has purchased the tickets, which are neither modifiable nor exchangeable.
If one or more Customer(s) registered on the same trip cancel their participation, which remains valid for the other Participants, the Agency reserves the right to revise the rates according to the updated number of Participants.
3.2- DURING THE TRIP:
Any trip that is interrupted, modified, or shortened, or any service that is not used due to the Customer(s) fault, for any reason whatsoever, will not give rise to any reimbursement or compensation from the Agency.
Any modification made by the Customer(s) involving a change of service (hotels, transport, etc.) or program (length of stay, stages, etc.) will be invoiced to the Customer(s).
A change of destination or date at the initiative of the Customer(s) or one of the Participants is considered as a cancellation.
All claims must be notified to the Agency in writing by registered letter with acknowledgement of receipt, accompanied by supporting documents, within 30 days of the return date of the trip.
Any disputes will be settled amicably.
In the event of complete disagreement, as the Agency is a company governed by local law, the courts of the city where the Agency is located will have jurisdiction.
By agreeing to travel with the Agency, the Customer(s) undertake to take out medical assistance and repatriation insurance, as well as cancellation insurance, which must be provided to the Agency prior to departure.
In the case of the Customer(s) flight ticket(s) were paid for by the Customer(s) bank card, or the deposit has been paid via the Agency‘s online payment service, the Customer(s) are likely to be covered.
Only the banking establishment concerned by this settlement can confirm or deny it.
The decision whether to take out such insurance or not, and the choice of insurance, are the sole responsibility of the Customer(s).
The Agency reserves the right to have Customer(s) sign a liability waiver upon arrival in the destination country.
In the case of high-risk activities (extreme sports, mountaineering/animism, diving, rafting, paragliding, etc.), Customer(s) must take out specific additional insurance and inform the Agency of this prior to departure.
The Agency is partnered with insurance companies and can offer insurance coverage to suit Customer(s) needs (cancellation, repatriation, comprehensive). Don’t hesitate to ask for more information directly from the travel designer in charge of your file.
The Agency has taken out a contract guaranteeing its professional civil liability under the conditions stipulated by current legislation.
Before registering to undertake the trip, each Participant of the Customer(s) must check, according to his or her personal situation, that he or she is in possession of a valid passport and/or other document(s) (national identity card, visa, family record book, authorization to leave the country for minors, vaccination booklet, driving license, etc.), in compliance with the requirements for transiting and/or entering the country(ies) of the trip.
Each Participant of the Customer(s) is responsible for obtaining all documents required by the authorities of the countries visited.
The Agency provides information on the administrative and/or health formalities required for these trips on its website and in the documentation provided.
This information is provided by the Agency for information purposes only, and does not engage its responsibility, nor replace the individual responsibility of each Participant of the Customer(s). We strongly advise you to check with the relevant authorities, such as consulates, prior to departure, for the list of documents required and the migration, health, and customs formalities in force.
The Agency cannot be held responsible for any delay or inability on the part of a Participant to present valid documents. The consequences of any failure to present such documents shall be borne entirely by the Customer(s), and any trip cancelled, interrupted, or shortened due to the Customer(s) fault shall not give rise to any reimbursement or compensation of any kind.
Customer(s) and Participants are required to inform the Agency and the guides accompanying them of their health and physical condition, to be considered when carrying out the activities.
Even if informed, the Agency and its guides cannot be held responsible for any accident resulting from the condition of the Customer(s) concerned.
It is the responsibility of the Customer(s) to check with their doctor(s) whether their state of health permits a prolonged stay at altitude for the destinations concerned.
In all cases, the Agency and its guides or service providers, cannot take the place of doctor(s) and Customer(s) in determining what is best for the health of participants, and the suitability of the proposed activities for the physical and mental condition of the Customer(s). It is the sole responsibility of the latter.
The Customer(s) and the participants in the trip are aware that, given the nature of the trip they have chosen, they may run certain risks due to the remoteness of medical centers, the state of roads, the adventurous nature of certain tours (particularly hikes, water sports, scuba diving, expeditions in all-terrain vehicles, etc.).
Organizations providing rapid evacuation in certain remote areas do not always exist.
The Customer(s) and Participants declare that they are aware of such risks and undertake, in the event of an accident, not to hold the Agency, its guides and various service providers liable.
If circumstances so require, and to ensure the safety of Customer(s) as a whole, also for climatic reasons or unforeseen events, the Agency reserves the right, directly or through its guides or service providers, to substitute one means of transport, accommodation, or itinerary for another, as well as departure dates or times, without the Customer(s) being entitled to claim any compensation.
Each Participant of the Customer(s) must comply with the rules of caution and community life, and follow the instructions given by the Agency‘s guide or service provider.
The Agency cannot be held responsible for accidents caused by the carelessness of the Customer(s). The Agency reserves the right to expel, at any time, from a group any Participant whose behavior may be considered as endangering the safety or well-being of the other Customer(s). No compensation will be payable.
If the Customer(s) concerned refuses to follow the guide’s instructions, the guide may ask the Participant to sign a disclaimer acknowledging the disagreement and releasing the Agency and the guide from all liability.
Customer(s) are responsible for any personal belongings in their care, including money, credit cards, jewelry, clothing, cameras, and videos.
The Agency cannot be held responsible for the loss, theft or deterioration of luggage or personal effects during the trip and cannot be held liable to compensate Customer(s) in such circumstances.
In the event of a problem, Customer(s) are advised to report the matter to the appropriate local authorities (file a complaint).
The quality of the hotel infrastructure may be inferior to that found in other parts of the world, and local standards of comfort and star rating may not correspond to those to which Participants are accustomed.
However, the Agency regularly works with hotels with which it maintains a relationship of trust.
The Customer(s) may not request a refund on the grounds of a difference of opinion regarding comfort.
If the trip is disrupted due to changes in the airline company for any reason outside the Agency‘s control, the Agency will make its best efforts to propose an alternative solution to the Customer(s).
Any resulting costs will be borne by the Customer(s).
The rights to claim or compensation are those applicable according to the local laws in force. These steps may only be taken by the Customer(s) in a personal capacity.
Local authorities may sometimes suspend certain visits and trips at the last minute for reasons of personal safety. The Agency cannot be held responsible for the consequences of this decision, which is a case of force majeure (e.g., loss of a boat transfer or air flights).
Should external events disrupt the normal operation of the country (e.g., political, and social unrest, natural disasters, strikes, road blockades and demonstrations, pandemics, etc.), the Agency reserves the right to cancel a trip or modify its content.
Customer(s) will be informed in advance of the context and any possible changes.
The Agency is above all responsible for the safety of Customer(s) taking part in the trips it organizes.
In the case of cancellation, the Agency will not be obliged to refund any amounts paid, and Customer(s) will not be entitled to any compensation.
In the case of changes to the itinerary due to external events, a new quote will be drawn up and offered to the Customer(s). And The Customer(s) will be responsible for all modification costs.
In the case of sudden devaluation of the local currency, the Agency reserves the right to re-evaluate the cost of the trip, giving the Customer(s) the choice of maintaining the service or cancelling it.
In addition, the Agency may be obliged to modify its rates and programs to take account of:
– variations in transport costs, particularly fuel costs.
– variations in fees and taxes related to any of the services provided, such as landing, embarkation, and disembarkation taxes.
PAYMENT OF A DEPOSIT FOR THE ORGANIZATION OF A TRIP IMPLIES ACCEPTANCE OF THESE GENERAL AND SPECIAL TERMS AND CONDITIONS OF SALE.
